Terms of Service — Trades & Gigs

These Terms of Service ("Terms") govern your access to and use of tradesandgigs.com (the "Site"), operated by Summit Supply and Contractors, LLC, a Georgia limited liability company ("Trades & Gigs," "we," "us"). By creating an account, listing a business, posting a job, or otherwise using the Site, you agree to these Terms.

1. What Trades & Gigs Is — and Isn't

Trades & Gigs is a connection platform. We help independent tradespeople and gig professionals ("Pros") create public listings so that potential clients can find and contact them directly, and we let Pros publish open roles that job seekers can apply to directly.

Trades & Gigs is not an employer, staffing agency, contractor, broker, or mediator. We are not a party to, and have no responsibility for, any agreement, job, service, transaction, hiring decision, or dispute between a Pro and a client, or between a Pro and a job applicant. We do not screen, supervise, direct, pay, or manage anyone's work.

2. Eligibility & Account Registration

You must be at least 18 years old and able to form a binding contract to use the Site.
You agree to provide accurate, current, and complete information when creating a listing, and to keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Pro Membership, Fees & Billing

Pro membership is a flat monthly subscription, currently offered at a Founder rate to the first 50 Pro members per state, as described on the listing page at the time of signup.
Subscriptions renew automatically each month until canceled. You can cancel anytime from your Business Dashboard; cancellation takes effect at the end of the current billing period.
If you cancel and later rejoin, you will be charged the then-current price, not your original Founder rate.
Job postings are billed as a separate, one-time fee per posting.
All payments are processed securely through Stripe. Fees are non-refundable except where required by law or expressly stated otherwise.
We may change pricing for new members at any time; changes will not affect an existing Pro member's locked-in rate as described on the Site.

4. Marketplace Referral Disclaimer

By listing a business or posting/applying to a job, you acknowledge and agree that:

Trades & Gigs does not guarantee any number of leads, inquiries, job applications, hires, or any particular business outcome.
Trades & Gigs makes no representation or warranty regarding the quality, safety, legality, timeliness, or workmanship of any Pro's services, or the accuracy of any listing, review, or job posting.
Trades & Gigs is not responsible for pricing, quotes, scheduling, payment disputes, property damage, personal injury, or any other outcome arising from a job or engagement arranged through the Site.
Each Pro is solely responsible for holding and maintaining any licenses, permits, bonds, and insurance required for their trade and jurisdiction, and for complying with all applicable federal, state, and local laws.

5. Pro & Client Responsibilities

Pros are independent business owners, not employees, agents, or representatives of Trades & Gigs. Clients and job applicants deal directly with Pros and are responsible for conducting their own due diligence, including verifying licensing and insurance, before engaging a Pro's services or accepting a position.

6. Content You Submit

You retain ownership of the photos, descriptions, and other content you submit ("User Content"). By submitting User Content, you grant Trades & Gigs a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute it on the Site and in related marketing for the purpose of operating the platform. You represent that you have the right to submit this content and that it does not infringe any third party's rights.

We reserve the right to review, edit, or remove any listing or job posting that we believe, in our discretion, violates these Terms, is misleading, or is inappropriate, including verifying license or bar numbers where applicable before a profile goes live.

7. Prohibited Conduct

Posting false, misleading, or fraudulent listings, reviews, or job postings.
Misrepresenting your licensing, insurance, or qualifications.
Using the Site to harass, discriminate against, or defraud another user.
Circumventing or interfering with the Site's payment, security, or verification systems.
Charging job applicants any fee to apply — job applications through Trades & Gigs are always free to applicants.

8. Third-Party Services

The Site relies on third-party services, including Google Firebase (hosting/database), Stripe (payments), and Meta (advertising analytics). Your use of features involving these services is also subject to those providers' own terms and privacy policies. We are not responsible for the acts, omissions, or downtime of third-party providers.

9. Disclaimer of Warranties

THE SITE AND ALL LISTINGS, JOB POSTINGS, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADES & GIGS AND SUMMIT SUPPLY AND CONTRACTORS, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY JOB, SERVICE, OR TRANSACTION ARRANGED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

11. Indemnification

You agree to indemnify and hold harmless Trades & Gigs and Summit Supply and Contractors, LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your listing or job posting, your violation of these Terms, or your work performed for or engagement with a third party found through the Site.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any conduct we believe is harmful to the Site, other users, or the public, with or without notice.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.
